Mental Health Act Practice

Navigating issues under Malaysia’s Mental Health Act 2001 can be overwhelming especially when a loved one is no longer able to make sound decisions about their personal welfare or finances.

CLC offers experienced, sensitive, and strategic guidance in all aspects of Mental Health Act applications, from the initial court filing to long-term administration of a patient’s affairs. Our practice involves both contentious and non-contentious applications or actions under the Mental Health Act 2001.

Our Services

We provide a full suite of services under the Mental Health Act 2001, including:

1. Applications for Committee of the Person and/or Estate
If a family member or loved one is incapacitated, we assist in preparing and filing applications to the High Court to appoint a Committee of the Person (to make decisions on healthcare, residence, and welfare) and/or Committee of the Estate (to manage financial and property matters).

2. Administration of the Patient’s Affairs
Once a Committee is appointed, ongoing duties include:

  • Managing the patient’s income, savings, and investments
  • Applying for sale or transfer of property (with leave of Court)
  • Submitting periodic accounts and reports to the Court
  • Ensuring expenses are incurred strictly for the patient’s benefit

We assist Committees in understanding and fulfilling their fiduciary obligations, including applications for directions or variations when circumstances change.

3. Estate Planning in Anticipation of Incapacity
Beyond reactive applications, we also advise clients on proactive Estate Planning to plan ahead through trusts, wills, and cross-border estate structures to ensure their affairs are protected in unforeseen circumstances.
