Inheritance disputes can have life-long impact to familial relationships. CLC’s aim is to provide clients with solutions that preserve their relationships and serve their long-term interests. With the rise of blended families, estate planning for blended families become less clear cut and in circumstances, inheritance issues can become complicated.
Cassandra has a strong background in disputes relating to the administration and distribution of deceased persons’ estates. In legal practice, this is commonly referred to as “Contentious Probate”. Disputes falling under the “Contentious Probate” description include cases where:
- a Will is contested on the grounds of forgery or the testator to be of unsound mind;
- domicile disputes to determine the laws of a country which is applicable in administering a deceased person’s estate;
- the need arises to remove an executor or administrator;
- a beneficiary seeks to revoke a Grant of Probate or Grant of Letters of Administration (“LA”);
- an executor or administrator is in breach of fiduciary duties.
Cassandra’s extensive experience in this area includes experiences in representing all interested parties like executors, administrators and beneficiaries in both domestic and cross-border Contentious Probate disputes. Cassandra has a strong experience in advising and acting for clients who are beneficiaries under estates with assets in multiple jurisdiction.
CLC’s experience include:
- Will writing for individuals with complex family structures coupled with setting up of trusts, where necessary;
- Assisting clients in their applications for Grants of Probate and Letters of Administration;
- Resealing of Grants of Probate and Administration obtained from other Commonwealth jurisdictions;
- Advisory work and Will writing in respect of estates which include assets in foreign jurisdictions;
- Advisory work on private wealth management and estate planning;
- Actions in contesting the validity of a will;
- Actions in revoking Grants of Probate and Letters for Administration;
- Claims against an executor or administrator for negligence or maladministration of an Estate;
- Resisting claims against the Estate;
- Disputes involving questions of the deceased person’s domicile;
- Actions to remove executors or administrators; and
- Actions to assert beneficiaries’ rights by obtaining Court Orders to compel an executor or administrator to carry out his/her duties.
